DMCA Policy

CNL Systems, Inc. ("CNL," "we," "us") respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the Service that are reported to our Designated Copyright Agent.

1Reporting Copyright Infringement

If you believe that material accessible on or through the Service infringes a copyright you own or control, you may submit a written notice ("DMCA Notice") to our Designated Copyright Agent. To be effective under the DMCA, your notice must include all of the following:

  • A physical or electronic signature of the copyright owner (or a person authorized to act on their behalf)
  • Identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered by a single notice, a representative list of such works)
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with sufficient detail to enable us to locate the material, including the URL or other specific location of the material on the Service
  • Information reasonably sufficient to allow us to contact you, such as your address, telephone number, and email address
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner

Notices that do not include all of the required information may not be processed.

3Response to DMCA Notices

Upon receipt of a valid DMCA Notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material (if applicable) that we have removed or disabled access to it
  • Forward the user a copy of the DMCA Notice

4Counter-Notification

If you believe material you posted to the Service was removed or disabled by mistake or misidentification, you may submit a written counter-notification ("Counter-Notice") to our Designated Agent. To be effective, your Counter-Notice must include all of the following:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside of the United States, for any judicial district in which CNL may be found), and that you will accept service of process from the person who provided the original DMCA Notice or that person's agent

If we receive a valid Counter-Notice, we will forward it to the person who submitted the original DMCA Notice. Unless the original sender notifies us within ten (10) business days that they have filed an action seeking a court order against you, we may restore the removed material.

5Repeat Infringer Policy

In accordance with the DMCA and other applicable law, CNL has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. CNL may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Do not submit a DMCA Notice or Counter-Notice without first carefully considering whether you are entitled to do so.
